Privacy policy, treatment and protection of personal data

 

With the authorization of the processing of personal data the owner of the same accepts the terms of this policy. Vennex Group S.A.S. is respectful of personal data and information provided by your current, past and potential customers. In this Personal Data Protection Policy, the purposes, measures and procedures of our databases are established, as well as the mechanisms available to the owners to know, update, rectify, suppress the information provided or revoke the authorization.

1. Legal framework

Article 15 of the Political Constitution of Colombia enshrines the right of any citizen to know, update and rectify the personal data that exists about him in databases and / or files of public or private entities. It also orders those who possess personal data of third parties to respect the rights and guarantees provided in the Constitution when that kind of information is collected, processed and circulated.

Statutory Law 1581 of 2012 establishes the minimum conditions to carry out the legitimate treatment of the personal data of clients, employees and any other natural person. The Literal (k) of Article 18 of this Act obliges those responsible for the processing of personal data to "adopt policies and procedures to ensure proper compliance and in particular, the attention of inquiries and complaints." On the other hand, article 25 of said Law states that the data processing policy is mandatory and that its lack of knowledge will result in sanctions. Said policy must guarantee at least the level of treatment established by this Law.

Chapter 3 of Decree 1377 of 2013 regulates aspects related to the content and requirements of the Information Treatment Policies and Privacy Notices.

Vennex Group S.A.S. undertakes to respect the data privacy rights of its customers, its employees and third parties in general. Therefore, it adopts the present Protection Policy, of mandatory application in all activities in which personal data processing is involved.

2. Obligatory

La presente política es de obligatorio y estricto cumplimiento por parte de todos los empleados de Vennex Group S.A.S., contratistas y terceros que obren a su nombre. Todos los empleados deben observar y respetar la presente Política en el cumplimiento de sus funciones, de conformidad con el Numeral 1 del Artículo 58 del Código Sustantivo del Trabajo, según el cual es obligación especial del trabajador “observar los preceptos del reglamento, acatar y cumplir las órdenes e instrucciones que de modo particular le impartan el patrono o sus representantes”.

En los casos en los cuales no exista vínculo laboral, se deberá incluir una cláusula contractual para que quienes obren a nombre de Vennex Group S.A.S., se obliguen a cumplir esta política.

El incumplimiento de la presente política originará sanciones de tipo laboral, o responsabilidad contractual según el caso. Lo anterior sin perjuicio del estar obligado a responder patrimonialmente por los daños y perjuicios que cause a los Titulares de los datos, y/o a Vennex Group S.A.S., por el incumplimiento de la misma o el indebido tratamiento de datos personales. En el caso laboral, de conformidad con el Código Sustantivo del Trabajo (CST) se considerará como justa causa para dar por terminado el contrato de trabajo, la violación grave o reiterada de esta Política (esto se deriva del Numeral 6 de los Artículos 62 y 6 del CST, modificado por el Decreto 2351 de 1965, en su “Artículo 7º – Terminación del contrato por justa causa”).

3. Definitions

A. Authorization. Prior, express and informed consent of the Holder to carry out the Processing of Personal Data.
 

B. Query. Request of the Data Owner or the persons authorized by him or by law, to know the information that is held about him in Databases or information files.
 

C. Database. Organized set of personal data that is the object of treatment.
 

D. Personal data. Any information linked to or associated with one or several natural persons determined or determinable. Data such as name, citizen identification number, postal address, e-mail address, telephone number, marital status, health data are some examples of personal data. Personal data is classified as sensitive, public, private and semi-private.
